Who we are
Apex CallWorks is a product of HD² Labs LLC ("we," "us," "our"), a Texas limited liability company with its principal place of business at 5000 Plaza on the Lake, Suite 100, Austin, TX 78746. We provide AI-powered call answering and lead recovery services to roofing businesses, primarily in Texas.
This Privacy Policy describes how we collect, use, and protect personal information in two distinct flows:
- Direct visitors and prospects. Roofing-business owners and operators who visit apexcallworks.com, take our revenue leak audit, or contact us about our services.
- Indirect data subjects. Homeowners and leads who call or are texted by a roofing business that uses Apex CallWorks. We process this data on behalf of our roofing-business customers as a service provider.
Different sections of this policy apply to each flow.
Information we collect from direct visitors
When you visit apexcallworks.com or interact with our services directly, we may collect:
- Identifying information you provide voluntarily, including your name, company name, business email, business phone number, role/title, and information about your roofing business (team size, average job value, jobs per year, estimates per week).
- Audit responses if you complete our revenue leak audit, including your answers to operational questions about your business.
- Communications when you email us, fill out a contact form, or book a call with our team.
- Technical information automatically collected when you visit our website, including IP address, browser type, device type, pages visited, and referring URL. We use this for analytics and security.
We do not knowingly collect sensitive personal data (as defined under the Texas Data Privacy and Security Act) from direct visitors.
How we use direct visitor information
We use information collected from direct visitors to:
- Provide the revenue leak audit and generate the resulting report
- Respond to your inquiries and provide customer service
- Send you the audit report and follow-up communications about Apex CallWorks (you can opt out at any time)
- Improve our services and develop new features
- Comply with legal obligations
We do not sell direct visitor personal data to third parties.
Information we process on behalf of our customers
When you call or are texted by a roofing business that uses Apex CallWorks, you are interacting with the roofing business's chosen service provider. The roofing business is the "controller" of your personal data. Apex CallWorks acts as a "processor" or "service provider" under that business's direction.
Data we may process on behalf of our customers includes:
- Phone numbers
- Call audio recordings and transcripts
- SMS message content
- Names, addresses, and other contact information you provide to the roofing business
- Information about the service you're inquiring about (roof type, damage description, insurance status)
If you want to access, correct, or delete this data, please contact the roofing business directly. We will support that business in responding to your request.
Use of Artificial Intelligence
Apex CallWorks uses artificial intelligence systems to answer phone calls, qualify leads, and send automated SMS messages on behalf of our roofing-business customers. When you interact with the Apex CallWorks service — whether by calling a roofing business that uses our platform or by receiving an SMS from one — you may be interacting with an AI system rather than a human.
We design our AI systems in alignment with the NIST AI Risk Management Framework. We do not use AI for behavioral manipulation, unlawful discrimination, or biometric identification of individuals.
Our AI receptionist is not a substitute for emergency services. If you have a life-threatening emergency, please hang up and dial 911. Our AI may occasionally misroute calls, mishear specific terms, or fail to capture every detail accurately. Our customer roofing businesses retain full responsibility for service quality and final business decisions.
SMS communications and TCPA compliance
Apex CallWorks provides automated SMS messaging on behalf of our roofing-business customers to leads and prospects who have consented to receive such communications. We do not initiate marketing SMS to any phone number except where our customer (the roofing business) has warranted that they have obtained prior express written consent from the recipient.
You may opt out of SMS communications at any time by:
- Replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any SMS
- Emailing team@apexcallworks.com with your phone number
- Emailing team@apexcallworks.com (phone line coming soon)
Opt-out requests are honored within ten business days. We honor opt-out requests communicated through any reasonable means, not just specific keywords.
If you received an SMS from a roofing business using Apex CallWorks and believe it was sent without your consent, please contact us at team@apexcallworks.com.
Texas privacy rights
Apex CallWorks is a small business as defined by the U.S. Small Business Administration. Most provisions of the Texas Data Privacy and Security Act (Tex. Bus. & Com. Code Ch. 541) do not currently apply to our processing of personal data. However, we voluntarily honor the following rights for Texas residents on a best-effort basis:
- Right to know what personal data we hold about you
- Right to correct inaccurate personal data
- Right to delete personal data
- Right to opt out of marketing communications
To submit a privacy request, email team@apexcallworks.com with the subject "Privacy Request" and include your name and the email address or phone number we may have on file. We will respond within 45 days.
Sub-processors and service providers
We use the following categories of service providers to operate Apex CallWorks. Each is bound by contractual obligations to protect personal data:
- Voice AI platform: to power our AI receptionist
- SMS platform: to send and receive text messages
- Database and authentication: to store data securely
- Email delivery: to send transactional and notification emails
- AI language models: to power conversational features
- Hosting and infrastructure: to make our service available
Business customers may request our current detailed sub-processor list by emailing team@apexcallworks.com. We provide reasonable notice before adding new sub-processors that process customer data.
For roofing business customers
If you are a roofing company using Apex CallWorks's service, your use of our platform is governed by our Master Services Agreement and Data Processing Agreement, which include detailed terms about our handling of your customer data. Request the DPA by emailing team@apexcallworks.com.
We act as a processor of personal data on your behalf. You remain the controller of the data your business collects from homeowners and leads. We maintain a current list of our sub-processors and provide notice before adding new ones.
Data retention
We retain direct visitor data (audit responses, contact submissions) for as long as necessary to provide our services and respond to your inquiries, and for a reasonable period afterward for business records (typically 24 months). You may request earlier deletion at any time by emailing team@apexcallworks.com.
We retain customer data (data we process on behalf of roofing-business customers) according to the terms of our Master Services Agreement with that customer. Customers may request return or deletion of their data at any time.
Security
We implement reasonable technical and organizational measures designed to protect personal data, including encryption in transit, access controls, and secure infrastructure providers. No system is perfectly secure, and we cannot guarantee absolute security. If we become aware of a data breach affecting your personal data, we will notify affected parties as required by applicable law.
Children
Apex CallWorks's services are not directed to children under 13. We do not knowingly collect personal data from children under 13. If you believe we have inadvertently collected such data, please contact us at team@apexcallworks.com.
Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page and update the "Last updated" date. Material changes will be communicated via email to known users.
